**Terms of Use**
### Article 1 (Definitions)
The definitions of terms used in this Agreement are as follows
1.**The Service**.
JapanConnect eSIM service and related services operated by the Company.
2. **Site**
The website on which the contents of the Service are posted. 3.
3.**Contents**.
A generic term for text, sound, still images, video, software programs, code, etc. (including posted information) provided on the Service.
4.**User**.
All persons who use the Service. 5.
5.**Registered Users**.
All persons who have completed user registration for the Site.
6.**ID**
A string of characters unique to the Registered User for use of the Service.
7.**Password**
A cipher set uniquely by the registered user corresponding to the ID.
8. **Personal Information**
Information that can identify an individual, such as address, name, occupation, telephone number, etc.
9.**Registration Information**
A generic term for information registered by a registered user on the Site (excluding posted information).
10.**Intellectual Property**.
Inventions, devices, new varieties of plants, designs, works of authorship and other items produced by human creative activity, trademarks, trade names and other items indicating goods or services used in business activities, and trade secrets and other technical or business information useful in business activities.
11.**Intellectual property rights**.
Patent rights, utility model rights, breeder's rights, design rights, copyrights, trademark rights, and other rights provided by law with respect to intellectual property or rights pertaining to legally protected interests.
### Article 2 (Agreement to these Terms and Conditions)
Users may use the Service upon agreeing to these Terms of Use. 2.
2. A contract of use in accordance with the various provisions of the TOS shall be established between the user and the Company at the time the user starts using the Service. 3.
(3) If the user is a minor, the user must obtain the consent of a person with parental authority or other legal representative before using the Service. (4) Minor users may not use the Service.
(4) If a minor user uses the Service by falsely claiming to have consent even though he/she does not have the consent of a legal representative, by falsely claiming to be of legal age, or by using other fraudulent means to make the user believe that he/she is of legal capacity, all legal acts related to the Service cannot be revoked. (5) If a minor user uses the Service after having obtained the consent of a legal representative, he/she may not be able to use the Service.
If a user who was a minor at the time of consenting to these Terms of Use uses the Service after reaching the age of majority, such user shall be deemed to have ratified all legal acts related to the Service.
### Article 3 (Modification of Terms and Conditions)
The Company may revise these Terms of Use at any time without the consent of the user, and the user agrees to such revisions without objection. 2.
When the Company revises the Terms of Use, it will notify the user of the contents of such revision by the method prescribed by the Company. 3.
Revisions to the Terms in the preceding paragraph shall take effect from the time the Company gives notice. 4.
Users will be deemed to have agreed to the revised Terms of Use without objection at the time they use the Service after the revision of the Terms of Use.
### Article 4 (Management of Accounts)
1. When you order an item on this site, a My Account will be automatically created with your e-mail address at the time of registration.
2. Users shall voluntarily register and manage the My Account information (hereinafter referred to as "Registration Information") that they have registered when using the Site (including e-mail addresses, IDs, passwords, etc.) at their own risk. 2. 4. if a user causes damage to us or a third party due to unauthorized use of the registration information, the user shall compensate us and the third party for such damage. 5.
Users shall manage their registration information at their own risk, and we shall not be liable for any disadvantages or damages incurred by users due to inaccurate or false registration information. 6.
6... If it is discovered that the registration information has been stolen or used by a third party, the user shall immediately notify the Company to that effect and follow the Company's instructions.
### Article 5 (Handling of Personal Information, etc.)
Personal information and user information shall be handled appropriately in accordance with the "JapanConnect eSIM Privacy Policy" separately stipulated by the Company.
### Article 6 (Prohibited Acts)
When using the Service, the following acts are prohibited by the Company. If the Company deems that a user has violated any of the prohibited acts, the Company may take any action it deems necessary, such as suspension of use or deletion of postings, and the user shall agree to such action without objection. 1.
(1) Infringement on the intellectual property rights of the Company or a third party
2. defaming the reputation or credibility of the Company or a third party, or unfairly discriminating against or libeling the Company or a third party
3. infringing or threatening to infringe the property of the Company or a third party
4. acts that cause economic damage to the Company or a third party
(5) acts that are threatening to the Company or a third party
6. use or induce computer viruses or other harmful programs
(7) Actions that place an excessive burden of stress on the infrastructure facilities for this service
8. attacks on the server, system, or security of this site; 9. attacks using any method other than the interface provided by the Company
9. attempting to access our service by means other than the interface provided by the Company
10. use of a terminal that does not conform to the technical standards set forth by laws and regulations
11. use of a terminal that is not compatible with JapanConnect eSIM service
12. acts prohibited by laws, regulations, rules, etc. in the country where the subscriber uses JapanConnect eSIM service
13. using JapanConnect eSIM Service for the purpose of child prostitution, viewing or acquiring child pornography, sending unsolicited email or SMS, or for any other purpose that the Company deems inappropriate
14. duplicating all or part of the information provided, including user qualifications for the JapanConnect eSIM system, for the use of a third party
15. having a third party perform any of the acts described in each of the preceding items
16. any other acts that the Company deems inappropriate.
### Article 7 (Handling of Contents)
1. Users may use the contents of this service only within the scope specified by our company. 2.
2. The Company retains the rights to all content provided by the Service, and does not license the user to use or license any patents, utility model rights, design rights, trademark rights, copyrights, or other intellectual property rights held by the Company. 3.
(3) Users are prohibited from reproducing, transmitting, transferring (including sales between users), lending, translating, adapting, reprinting without permission, secondary use, commercial use, modifying, disassembling, decompiling, reverse engineering, etc. by any means beyond the scope of use specified by the Company.
Notwithstanding the preceding paragraph, if a user loses his/her user status due to withdrawal from membership, etc., the right to use the provided content shall also cease to exist.
### Article 8 (Paid Content)
1. You may purchase paid content for a portion of the Service by paying a fee. The amount of paid content, payment method, and other matters shall be determined separately by the Company and displayed on the Service or on services provided by the Company. 2.
2. the Company may change the price of free or paid contents in the Service at its discretion. 3.
If a user delays payment for paid content, the user shall pay a late fee to our company at the rate of 14.6% per annum. 4.
4. the use of the Paid Content is licensed only for the user's own registered information.
### Article 9 (Disclaimer)
(1) The Company shall not be liable for any damages whatsoever resulting from changes in the contents, interruption, or termination of the Service.
(2) The Company shall not be involved in, and shall not be liable for, the user's environment for using the Service. 3.
(3) The Company makes no warranty that the Service will be suitable for the user's specific purpose, that it will have the expected functions, commercial value, accuracy, or usefulness, that the user's use of the Service will conform to the laws and regulations applicable to the user or the internal rules of any industry organization, or that it will not cause any defects. (4) SBM does not warrant that the Service will be accurate or useful in any way.
The Company does not guarantee that the Service is compatible with all information terminals, and the user acknowledges in advance that malfunctions may occur in the operation of the Service as a result of OS upgrades, etc. of the information terminal used for use of the Service. The Company does not guarantee that such defects will be resolved by the Company's modification of the program, etc. in the event of such defects. 5.
(5) The Company shall not be liable for any damages incurred by the user directly or indirectly as a result of using the Service. (6) The Company shall not be liable to the user or any other third party for any damages incurred by the user or any other third party.
6. the Company shall not be liable for any loss of opportunity, business interruption, or any other damages (including indirect damages and lost profits) incurred by users or other third parties, even if the Company has been notified of the possibility of such damages in advance.
7. the provisions of paragraph 1 through the preceding paragraph shall not apply in the event of intentional or gross negligence on our part, or in the event that the contractor is a consumer under the Consumer Contract Act. 8.
8. even if the preceding paragraph applies, SBM shall not be liable for any damage caused to the user due to negligence (excluding gross negligence). Even if the preceding paragraph applies, we shall not be liable to compensate for any damage arising from special circumstances among damages incurred by users due to acts of negligence (excluding gross negligence). 9.
In the event that we are liable for damages in connection with the use of this service, we shall be liable for damages up to the amount of usage received from the user in the month in which the relevant damages occurred. 10.
10. we shall not be liable for any disputes or troubles between users and other users. In the event that a dispute arises between a user and another user, both parties shall be responsible for resolving the dispute and shall not make any claim against the Company. 11.
11. in the event that a user causes damage to another user or has a dispute with a third party in relation to the use of this service, the user shall compensate for such damage or resolve such dispute at the user's own expense and responsibility, and shall not cause any trouble or damage to our company.
In the event that our company receives a claim for damages from a third party due to the user's actions, the user shall resolve such claim at the user's expense (attorney's fees) and responsibility. In the event that this company pays compensation for damages to said third party, the user shall pay all costs (including attorney's fees and lost profits) including said compensation for damages to this company. 13.
13. if the user causes damage to our company in relation to the use of this service, the user shall compensate our company for the damage (including legal costs and attorney's fees) at the user's expense and responsibility.
### Article 10 (Posting of Advertisements)
Users understand and agree that the Service may contain advertisements of any kind, and that the Company or its partners may place advertisements of any kind on the Service. The form and scope of advertisements on the Service may be changed by the Company at any time.
### Article 11 (Restriction, Suspension, Discontinuance, Suspension of Use, etc.)
In the event of a natural disaster, incident, or other emergency, SOFTBANK TELECOM may restrict the use of JapanConnect eSIM Service in order to give priority to communications necessary for disaster prevention or relief, ensuring transportation, communication, or power supply, maintaining order, or other public interests. 2. SBM may restrict the use of the JapanConnect eSIM Service.
2. SOFTBANK TELECOM may control the speed and volume of telecommunications by, for example, detecting telecommunications performed using communication procedures or applications that continuously and heavily occupy bandwidth and controlling the bandwidth allocated for such telecommunications.
3. SOFTBANK TELECOM may suspend or restrict the use of JapanConnect eSIM Service to a Subscriber for any of the following reasons
(1) When the Subscriber delays payment of the Service Charges or other obligations under this Agreement.
(2) When the Subscriber notifies false facts to SOFTBANK TELECOM
3. when SOFTBANK TELECOM recognizes that the subscriber has violated the provisions of Article 6 (Prohibited Acts)
(4) When the credit card designated by the subscriber can no longer be used
4. SOFTBANK TELECOM may take the following measures with respect to communications for JapanConnect eSIM Service: (1) When the subscriber's line is used for data communications.
(1) When SBM acknowledges that the subscriber's line has been in a state in which data communication can be performed (hereinafter referred to as "session") for a long period of time. (1) When SBM recognizes that the subscriber's line has been in a state in which data communication is possible (hereinafter referred to as "session") for a long time, SBM may disconnect the communication.
(2) When SOFTBANK TELECOM recognizes that a large number of communications have been made within the same session, SOFTBANK TELECOM may disconnect such communications. 5.
SOFTBANK TELECOM may suspend provision of JapanConnect eSIM Service in the following cases: 1.
(1) When maintenance or construction of our telecommunications facilities or systems is unavoidable. (2) When a telecommunications carrier sends a notice of termination to us.
(2) When telecommunications carriers stop providing telecommunications services to us
(3) When a cloud service provider stops providing cloud services to us
(4) When it becomes necessary to suspend the service due to regulations, etc. (6) When JCI is required to suspend the service pursuant to the preceding paragraph
When SOFTBANK TELECOM suspends the use of JapanConnect eSIM Service pursuant to the preceding paragraph, SOFTBANK TELECOM will post a notice on its website, etc. in advance. However, this shall not apply in the event of an emergency or unavoidable circumstances. 7.
7. we may discontinue all or part of the JapanConnect eSIM service when it is unavoidable due to technical, business execution, or regulatory reasons.
### Article 12 (Termination of Service)
The Company may terminate the Service by giving notice to Users in an appropriate manner. 2.
(2) Users agree without objection in advance that if the Service is terminated, they will lose all rights to use the Paid Content and will not be able to use said Paid Content thereafter. (3) In the event of termination of the Service for any reason, the Company shall not be liable for any damages incurred by the user or third party resulting from such termination.
In the event of termination of the Service for any cause, the Company shall not be liable for any damages incurred by the User or any third party resulting from such termination.
### Article 13 (Refunds, Cancellations and Changes)
1. the Subscriber reserves the right to request a refund and modification if the Subscriber is unable to install or use the eSIM due to technical problems caused by the Service; and
2. in order to determine whether the problem is a technical problem caused by the Service, the Subscriber should follow the instructions or provide the information and images provided by Customer Support when the problem occurs. 3.
3. no refund will be made if the information provided by Customer Support is not provided. 4.
4. if activation is still not possible after being guided by Customer Support, a refund request can be made within the eSIM expiration date.
5. no refund will be accepted for remaining data once the expiration date has expired.
6. no refunds will be made for charges incurred for alternative phones, SIM cards, hotel calls, etc., and charges that are not directly connected to the customer's eSIM account. (For more information, please refer to Article 9 (Disclaimer). 7.)
7. we reserve the right to deny refunds if there is evidence of abuse, violation of the Terms of Service, or fraud in connection with the use of goods or services
It is the user's responsibility to verify that the user's device is an eSIM compatible device and that the device is SIM unlocked. By agreeing to check the "eSIM compatible device" and "SIM unlocked device" on the purchase screen, the user confirms the compatibility of the device and is deemed to have used the service. In the following cases, refunds will not be accepted after 30 days of purchase.
When the user's handset is not compatible with eSIM
If the SIM lock of the user's terminal has not been unlocked.
9. Other requests that are not allowed under the refund policy posted on this site will not be accepted for return or refund.
### Article 14 (Prohibition of transfer of rights)
1. The user shall not transfer all or part of the user's position under these Terms of Use and rights or obligations under these Terms of Use to a third party without the prior written consent of the Company. 2.
2. the Company may transfer all or part of the Service to a third party at the Company's discretion, in which case all rights of the User pertaining to the Service, including the User's account, shall be transferred to the transferee to the extent of the rights transferred.
### Article 15 (Severability)
Even if any provision of these Terms and Conditions or part thereof is determined to be invalid or unenforceable under the Consumer Contract Act or other laws or regulations, the remaining provisions of these Terms and Conditions and the remaining portions of any provision that is determined to be invalid or unenforceable in part shall remain in full force and effect.
### Article 16 (Method of Contacting the Company)
Users' communications and inquiries to the Company regarding the Service shall be made by submitting them via the inquiry form provided on the Service or on the website operated by the Company at the appropriate location, or by other methods separately designated by the Company.
### Article 17 (Governing Law, Court of Jurisdiction)
The validity, interpretation, and performance of these Terms of Use shall be governed by and construed in accordance with the laws of Japan. 2.
2. The Tokyo Summary Court or the Tokyo District Court shall have exclusive jurisdiction over any and all disputes, lawsuits, or other controversies between the Company and the Users, etc., depending on the amount of the suit.
